Woman sues food company Kraft Heinz for $5 Million for delay in preparing her pasta

Unhappy that her pasta takes longer than the supposedly-promised time to prepare, a Florida woman is suing American food company Kraft Heinz for $5 million.

Amanda Ramirez alleges in her class action lawsuit filed on November 18 that Kraft Heinz Company (KHC) violated federal law by saying Velveeta microwavable mac and cheese cups take 3.5 minutes to prepare, court records reveal.

The box states that Velveeta Shells & Cheese are “Ready in 3½ minutes”, which is the amount of time the macaroni pasta takes to cook in a microwave.

But the suit — filed in the U.S. District Court for the Southern District of Florida — says the product takes more time to be prepared as the process involves other steps, according to a WFLA report.
The cooking process as described by the lawsuit:
“First, consumers must ‘REMOVE lid and Cheese Sauce Pouch.’
  • Next, they must ‘ADD water to fill line in cup. STIR.’
  • Third, ‘MICROWAVE, uncovered, on HIGH 3-1/2 min. DO NOT DRAIN.’
  • Finally, they should ‘STIR IN contents of cheese sauce pouch.’
  • Defendant then notes that ‘CHEESE SAUCE WILL THICKEN UPON STANDING’.”
“Consumers seeing ‘ready in 3½ minutes’ will believe it represents the total amount of time it takes to prepare the Product,” argues the suit.
“Meaning from the moment it is unopened to the moment it is ready for consumption.”
While the lawsuit claims the plaintiff bought the mac and cheese cups at a “premium price” of $10.99 between October and November 2022, it does not mention the time it took the Hialeah woman to prepare her pasta.
Ramirez, described by her documents as a consumer who “looks to bold statements of value when quickly selecting groceries”, is seeking $5 million or Rs 40 crore and 80 lakh in damages.
Meanwhile the Kraft Heinz Company, in a media statement about the litigation, termed it a “frivolous lawsuit”.
“We are aware of this frivolous lawsuit and will strongly defend against the allegations in the complaint,” the multinational brand told News Channel 8.
